ASAE General Counsel Shares Form 990 Resources: ASAE has partnered with its general counsel Jerald Jacobs, Esq., of Pillsbury Winthrop Shaw Pittman LLP, to create sample governance policies to assist associations preparing to file the new Form 990 next year.
More information is needed by the IRS and the public about how tax-exempt organizations operate and the new Form 990 has been created for this very purpose. The new Form 990 delves deeper into organizations' executive and key employee compensation, political activities and governance, among other areas.
Part IV of the form asks all tax-exempt organizations, regardless of size/type, to disclose whether they have a number of policies in place, including conflict of interest, whistleblower and document retention policies. Some of these policies are not required of tax-exempt entities; however the IRS has indicated they will use associations' responses to develop an overall assessment of organizational compliance.
If you would like more information register for the following ASAE program: “Living With the New Form 990”
Date & Time:
October 3rd at 11 am ET
Location:
Washington, DC or use call in option
Speakers:
Jerald Jacobs & Charles Tate, CPA

Senator Chuck Grassley (R-IA) recently announced that he will support legislation to allow the IRS to change the mileage rate for calculating deductible costs of operating a vehicle for charitable purposes.
The Fair Deal for Volunteers Act of 2008 will be signed by Grassley in co ordinance with Ben Cardin (D-MD) who introduced the Act. The bill is pending in the Senate Finance Committee. Previously the charitable mileage rate had become fixed in statute as a part of the Deficit Reduction Act of 1984.
Grassley was quoted as stating the following, “People who volunteer for charity aren't out to make money, but they shouldn't loose money in the process. Driving a car is more expensive than ever, and driving is crucial to a lot of volunteer activities. With high gas prices, some people might decide they can't afford to deliver meals to the homebound. It makes sense to give the IRS the flexibility to set mileage rates for charity work.”
