Senate Passes 1099 Repeal Amendment in FAA Bill
The Senate February 2 adopted an amendment to legislation reauthorizing the Federal Aviation Administration (FAA) repealing the new Form 1099 reporting requirements enacted as part of the health care law.
The amendment, sponsored by Sen. Debbie Stabenow (D-MI), completely repeals the expanded 1099 reporting requirement in the new health care law and pays for the repeal with unspent appropriated funds, or already appropriated money from various federal agencies, as directed by the Office of Management and Budget. The amendment passed 81-17 with unanimous Republican support and 34 Democrats voting in favor. The bipartisan nature of the vote was in stark contrast to the amendment that would have repealed the entire health care bill, offered by Senate Minority Leader Mitch McConnell (R-KY), which failed on a party-line vote.

ASAE Urges Congress to Remove the 1099 Burden
ASAE will deliver a sign-on letter next week to members of the House urging them to support repeal of the new Form 1099 reporting requirements scheduled to take effect in 2012.
As noted above, House leaders are intent on holding a 1099 repeal vote in the near future. The Senate passed 1099 repeal language last week.
The new 1099 rules add purchases of goods to the types of payments companies and tax-exempt organizations must report to the IRS. Starting in 2012, companies would have to complete a 1099 for any vendor from which it purchased $600 or more in goods or services in a year, and then send the form to the IRS and the vendor. ASAE and others have pointed out that the change would result in some businesses and associations having to issue hundreds or even thousands of forms each year, track cumulative payments to vendors, and obtain tax identification information from each vendor. The 1099 provision was written into the health care law as an offset after congressional tax analysts estimated that the additional reporting would increase tax compliance to the tune of $19 billion over 10 years.
ASAE’s sign-on letter is the same letter delivered to Congress last November. If your name is already on the letter and you support 1099 repeal, there is nothing you need to do. If you would like your name or organization’s name removed from this letter, please send an email to rhay@asaenet.org.
